CLIENT REQUESTS: a home inspection on the property identified at the above address by Trebor Home Inspections LLC. hereinafter referred to as the “Inspector”. Inspector agrees to perform a limited visual inspection of the structures readily accessible items, components and systems and to provide Client with a written opinion as to their apparent general condition including identification of significant observable deficiencies, as they exist at the time of the inspection. The inspection will be performed in a manner consistent with the Standards of Practice of the International Association of Certified Home Inspectors (InterNACHI). A copy of these standards is available at both the InterNACHI (www.nachi.org) and Trebor Home Inspections (www.treborhomeinspections.com) websites.

CLIENT WARRANTS: that all approvals necessary have been secured for the Inspector’s entrance on to the property, all areas of the property are accessible and all systems and the utilities required to operate those systems are turned on. Client will read the entire Inspection Report and all comments in the report will be considered prior to closing on the property

SCOPE OF INSPECTION: The inspection only includes those items, components and systems specifically identified in the inspection report. Any item, component or system which is inaccessible, concealed or not readily exposed to view because of furnishings, carpets, stored belongings, ceilings, walls, floors, soil or other obstructions, or those items or areas which have been excluded is not included in this inspection. The inspection does not include any dismantling or invasive testing techiques. In addition to the other limitations included in this Agreement, Client agrees to assume all the risk for all conditions which are concealed from view at the time of the inspection or exist in any area excluded from the inspection by the terms of this agreement. The following items, components, systems and areas are among those NOT INCLUDED in the scope of the inspection:

Code or Zoning Violations/ Permit, property boundary, easements or right of way verification or research/ Building value appraisal/ ADA compliance/ Repair cost estimates/ Efficiency of any system/ Prediction of life expectancy of any item/ Latent or concealed defects/ Analytical testing or engineering of structural, geological or hydrological conditions/ Asbestos, radon gas, lead paint, mold or formaldehyde/ Toxic or flammable chemicals/ Water and air quality/ PCB’s or other toxins/ Electro­magnetic fields/ Underground storage tanks/ Proximity to toxic waste sites/ Sick Building Syndrome or other non visible environmental or health hazards/ Spas, saunas, steam baths or hot tubs/ Swimming pools/ Fountains or other aesthetic water features/ Water softeners or purifiers/ Private water or sewage systems/ Radio controlled devices/ Telephone and cable television wiring and service/ Automatic gates/ Elevators or dumbwaiters/ Thermostatic or time clock controls/ Radiant heat systems/ Furnace heat exchangers/ Solar heating systems/ Heat recovery units/ Gas fire pits, barbecues, portable space heaters, lamps, and pool heaters/ Main gas shut off valve/ Gas leaks/ Seismic or hurricane safety/ Flood zone determination or previous flood history/ Security systems/ Sprinkler systems/ Fire safety/ Low voltage and landscape lighting systems/ Proximity to railroad tracks, airplane routes or sources of odors or noise/ Unique or technically complex items, components or systems/ Items specifically noted as not inspected in the inspection report

If inspection is desired of any of the items, components, systems or areas listed above, then client shall contact the appropriate specialists.

4.

CONFIDENTIAL REPORT:The inspection and report are performed and prepared for the sole and exclusive use and possession of the Client and their agent(s) during the real estate transaction for the property listed above. No other person or entity may rely on the report issued pursuant to this Agreement. Unless directed otherwise, Inspector will deliver the report only to the Client and the Real Estate Agent directly representing the Client. In the event that any person, not a party to this Agreement, makes any claim against Inspector arising out of the services performed under this Agreement, the Client agrees to indemnify, defend and hold harmless Inspector from any and all damages, expenses, costs and attorney fees arising from such a claim.

LIMITATION ON REPORT: Client understands that the inspection and the inspection report do not, in any way, constitute a: guarantee; warranty of merchantibility or fitness for a particular purpose; express purpose or warranty or insurance policy. Additionally, neither the inspection nor the inspection report is suitable for any real estate transfer disclosures that may be required by law. The written report prepared by the inspector shall be considered the final and exclusive findings of Inspector of the structure. Client understands and agrees that Client will not rely on any oral statements made by the inspector prior or subsequent to the issuance of the written inspection report. Client further understands and agrees Inspector reserves the right to modify the inspection report for two business days after the inspection report has first been delivered to the Client.

6.

COMPLETION INSPECTION: Client may request, for an additional fee, a completion inspection of the property. The client understands that a completion inspection is a visual verification of whether repairs have been or have not been performed, on items of concern listed in the original inspection report and subsequently included in an Agreed Repairs Addendum. Client understands that the multi layered construction of most home components and systems prevents any person other than the professional performing the repair from accurately assessing the appropriateness or durability of the repair. The visual verification cannot determine if a repair was or will be successful. The client agrees to obtain copies of both the repair contract and warranty issued by the licensed professional performing the repair to ensure follow up work should the repair not perform as required. The client understands that Trebor Home Inspections does not warranty or guarantee the quality of any repair work performed on the property.

7.

LIMITATION ON LIABILITY: It is agreed that Inspector and heirs, are not in anyway insurers of the property inspected and that payments for the inspection services provided herein are based solely upon the value of those services, and it is not the intention of the parties that Inspector assume responsibility: for any loss occasioned by malfeasance or misfeasance in the performance of the services under this Agreement; for any loss or damage sustained through burglary, theft, robbery, fire or other cause; for any liability on the part of Inspector by virtue of this Agreement or because of the relationship hereby established. If there shall, notwithstanding the above provision, at any time be, or arise, any liability on the part of Inspector by virtue of this Agreement, or because of the relationship hereby established, whether due to the negligence, omission, breach of contract, misrepresentation of Inspector or otherwise, such liability is, and shall be limited to, a sum equal to the price charged for the inspection service, which sum shall be paid and received as liquidated damages. Such liability is herein set forth as liquidated damages and not as a penalty, and this liability shall be complete and exclusive. Inspector makes no warranties, expressed or implied, and any such warranty is specifically excluded and exclaimed.

8.

DISPUTES: Client understands and agrees that any claim for failure to accurately report the visually discernible conditions at the subject property, shall be made in writing and reported to the inspector within ten business days of discovery. Client further agrees that, with exception of emergency conditions, Client or Client’s agents, employees or independent contractors will make NO alterations, modifications or repairs to the claimed discrepancy prior to a re-inspection by the inspector. Client understands and agrees that any failure to notify Inspector as stated above shall constitute a waiver of any and all claims for said failure to accurately report the condition in question. The prevailing party in any dispute arising out of this agreement, the inspection, or report(s) shall be awarded all reasonable attorney’s fees, arbitrator fees and other costs.

9.

PAYMENT: is due on the day of the Inspection. Inspection reports will not be released until payment is received.. A $50.00 fee will be added to all returned checks. A 10% late fee (per month) will be charged for all late payments. All costs, including but not limited to, collections, liens & legal fees to recover past due payments will be added to the customer final bill. Trebor Home Inspections reserves the right to adjust the fee, shown in this agreement, if the specifications stated when scheduling the inspection differ from those discovered on site at the time of the inspection.

10.

CLIENT WARRANTS: that client has carefully read and understands this entire Agreement and acknowledges they are bound by all the terms of this Agreement and that this document represents the entire agreement between the parties. No oral agreements, understandings or representations shall change, modify or amend any part of this agreement. If any portion of this Agreement is found to be invalid or unenforceable by any court or arbitrator the remaining terms shall remain in full force and effect between the parties.

I have read, understand and agree to all the terms and conditions of this contract and to pay the fee listed above.
